Principles of a personal data register related to assignments
1. Reason for processing personal data
We process personal information because:
(i) processing is necessary for the implementation of the agreement in which the registered is a party, or to conclude pre-contractual measures at the request of the registered;
In practice, for example, we need personal information from the inventors / model creators to file a patent/design application. Company / applicant contact information is required for requesting order instructions.
(ii) processing of data is necessary for the registrar or to carry out legitimate interests of a third party, unless data protection requires interests or basic rights and freedoms of the registered to displace such advantages, especially if the registered is a child.
Often the applicant is different from the inventor. The inventor information is needed to protect the applicant’s rights. In addition, practically in all countries, it is obligatory to submit to the office information about the inventor / model creator.
2. Personal information to be collected
Company / applicant’s representative details for assignments:
Name of the company / applicant, name of the person, position in the company / with respect to the applicant, contact details (email, phone number, Skype ID etc.) for contact and confirmation of orders.
Inventor information relating to orders:
Inventor’s name, inventor’s home address, inventor’s nationality and / or domicile, industrial property reference (patent number, application number, name of the invention or other reference, general number related to industrial property (patent, trademark, design), inventor’s contact information (email, phone number, Skype ID etc.)) for contact and execution of orders. Relationship between the inventor and the applicant.
3. Registry holder and access to information
Registrar: Moosedog Oy.
Access to information is limited to Moosedog Oy personnel. Some of the assignments include, in essence, the sharing of information relating to orders to a subcontractor who executes an order or part thereof (subcontractors such as foreign attorneys during the prosecution of the applications and during their validity) and to the authorities.
The data is stored in a password-protected part of the system that is accessible only by designated persons.
4. The right of inspection
A company representative (in terms of orders) can exercise its right of control to find out what information about him/her has been stored in the client register. The right of inspection is requested by a signed document to Moosedog Oy. Upon request, Moosedog Oy shall promptly correct or remove any information in the client register that is not required to meet obligations.
The inventor (in relation to the orders) can exercise its right of control to find out what information about him/her has been stored in the client register. The right of inspection is requested by a signed document to Moosedog Oy. The document must include an authorization from the applicant / holder of an industrial property right that the inventor has the right to obtain information relating to the industrial property right. Upon request, Moosedog Oy shall promptly correct or remove any information in the client register that is not required to meet obligations.
